Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks lawful basis.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.
The situation stems from a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to answer alien smuggling allegations, he was held in immigration detention.
In her decision, the court pointed out that the government does not have a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

The legal proceedings involve conflicting assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in the state of Tennessee.

The court, who was overseeing his petition to deportation in a federal court, determined that he must now comply with the terms of his bond from custody in Tennessee. This order effectively transfers his supervision to the Tennessee court.
